On October 20, the Association of Ukrainian Banks continued its series of practical online webinars with an event on “How to identify and record procedural errors made by the investigation team during a search of a financial institution.” The webinar was attended by over 30 representatives of banking institutions, heads of legal departments, compliance officers, security directors, and risk management specialists.
During the event, participants discussed a number of practical aspects related to the bank’s actions during searches and the proper legal recording of procedural violations.
Key topics included:
- common mistakes made by lawyers during searches and how to avoid them;
- the algorithm of actions for a lawyer from the moment of arrival at the search to the completion of procedural actions;
- effective interaction between the company’s lawyer, external lawyer, and security personnel during the search;
- actions after the search is completed — analysis of protocols, recording of violations, work with the media, and restoration of operational activities;
- lawyer’s KPI: how to evaluate the effectiveness of defense — by the number of recorded violations, prevention of seizure of critical data, return of property, and the response of the investigation.
The webinar was presented by Denis Ovcharov, President of SB-CLUB and Head of Business Protection Practice at ADER HABER law firm. The expert shared his own cases and advice on tactics for conducting investigative actions, emphasizing that the main task of a lawyer is not only to record violations, but also to build a system of preventive business protection.
The webinar was held as part of an educational initiative by the Association of Ukrainian Banks aimed at raising the level of legal awareness among representatives of the financial sector and developing practical skills for responding to crisis situations.
